Terms And Conditions

Your GetAways Advantage Vacation Exchange Membership includes a timeshare exchange benefit called GetAways Advantage Vacation Exchange. GetAways Advantage Vacation Exchange is governed by the terms and conditions outlined below. You must be a timeshare (resort week or points) Owner to receive and utilize this exchange benefit. Your Ownership Plan may have further terms and conditions in addition to the below, but it will not modify or override any of the following terms and conditions.

In order for a Resort Week Owner to participate in the GetAways Advantage Vacation Exchange, the following conditions must be met:

​

(i) The Resort Week Owner must not be in default under their purchase contract or membership agreement with their respective Resort or Timeshare Plan and be current on all annual maintenance fees, assessments, dues, taxes, and other charges relating to their ownership/membership.

​

(ii) The Resort where Resort Week is located must be operated in a commercially reasonable fashion with minimum standards as determined by GetAways Advantage Vacation Exchange in its sole discretion; and

​

(iii) The Resort Week Owner must have the sole ownership and/or use rights in the Deposited Week at the time the Exchange is confirmed.

The GetAways Advantage Vacation Exchange Program provides Members with the opportunity to exchange your Vacation Time for Inventory made available in connection with the GetAways Advantage Exchange Program. Members have two options for effectuating an Exchange: the Search First Option and the Bank and Save Option (Deposit First Option). Regardless of whether you desire to employ the Search First Option or the Bank and Save Option, you must be in compliance with the Terms and Conditions of this Membership Terms and Conditions in order to make an Exchange.

The Search First Option: This option enables Members to search for Inventory and select the Deposited Week or Additional Inventory of their choice. Once you choose a Deposited Week or Additional Inventory for your exchange, you deposit your Vacation Time with GetAways Advantage Vacation Exchange Program and make an Exchange Request. Upon receipt of an Exchange offer, you may choose to accept or decline the Exchange offer. Upon acceptance of an Exchange offer, you must pay the applicable Exchange Fee (and, as applicable, Unit Size Upgrade Fee), and confirmation of the Exchange is delivered to the member via email or via post mail to the member for presentation at the Resort upon check-in.

The Bank and Save Option (Deposit First Option): This option enables Members to deposit (bank) Vacation Time into the Week Pool and use a credit received to make an Exchange at a later date. Upon depositing your Vacation Time, you will receive a Deposit Credit to redeem at any time within three (3) years from the date of deposit. Your Deposit Credit is what enables you to make an Exchange. You can then search the Week Pool and select from available Inventory at any time during the three (3) year term and make an Exchange Request. Upon receipt of an Exchange offer from GetAways Advantage Exchange Program, you may choose to accept or decline the Exchange offer. Upon acceptance of an Exchange offer, you must pay the applicable Exchange Fee (and, as applicable, Unit Size Upgrade Fee), and confirmation of the Exchange is delivered to the member via email and again via post mail to the member for presentation at the Resort upon check-in.

Additionally, Members who use the Bank and Save Option may make an Exchange Request before finding suitable Inventory in the Week Pool. GetAways Advantage Vacation Exchange Program, in its discretion, may place restrictions on the number and type of searches a Member may place at any time. In this case, you must submit an Exchange Request for future Inventory and you are then added to a waitlist for the appropriate Vacation Time. Once a Vacation Time matching your Exchange Request is deposited into the Week Pool, the first Member on the appropriate waitlist is contacted with an Exchange offer.  Upon receipt of an Exchange offer, you may choose to accept or decline the Exchange offer. Upon acceptance of an Exchange offer, you must pay the applicable Exchange Fee (and, as applicable, Unit Size Upgrade Fee), and confirmation of the Exchange is delivered to the member via email and again via post mail to the member for presentation at the Resort upon check-in.

Exchange Requests may be made up to one (1) year in advance and no less than thirty (30) days in advance of the desired travel dates. Exchange Requests will generally be processed on a first-come, first served, space available basis, in the order in which they are received.  Exchange Requests may specify a particular Resort and/or dates; however, flexibility on dates and/or destinations will increase the likelihood of a successful Exchange. In order to provide the greatest flexibility for Members, GetAways Advantage Exchange Program generally works with a number of different Resorts within any particular vacation area, as opposed to specific Resorts within any particular area. To increase your likelihood for receiving a Confirmed Exchange, we recommend including several different vacation areas and at least 2 or 3 dates in each Exchange Request with a limited travel window of three (3) months. Exchange Requests are arranged and confirmed on a space-available basis, and there are no guarantees of fulfillment of any Exchange Request. GetAways Advantage Exchange Program reserves the right, in its sole discretion, to cancel, amend or modify the process for Exchange Requests at any time.

During periods of high demand, i.e. national holidays, peak summer vacation weeks and school holidays, and at Resorts located in high demand vacation areas, space availability is limited. Members requesting Exchanges for these times and at these Resorts are encouraged to request Exchanges as early as possible, subject to the terms hereof. In fact, all Members are encouraged to submit Exchange Requests as far as possible in advance of their requested vacation dates, subject to the provisions hereof.

Use of Deposited Inventory

Participation in the Exchange Program is for personal, non-commercial purposes only. The commercial use, including without limitation the auction, rental or sale of Resort Weeks obtained through the GetAways Advantage Vacation Exchange, whether by Exchange, Bonus Time or Additional Benefits is strictly prohibited. However, exchanging GetAways  Advantage Members may assign their Resort Weeks to Guests as set forth in this document. The only Person who may make an Exchange Request or receive a Confirmed Exchange, with respect to a Deposited Week, shall be the Resort Week Owner of such Resort Week. A Confirmed Exchange may only be used by an GetAways Advantage Member or Guest whose name appears on the confirmed reservation. The Member that chooses to deposit his week relinquishes all rights to the use and occupancy of his/her Resort Week upon depositing it into the Week Pool. GetAways Advantage Vacation Exchange reserves the right to assign the deposited Resort Weeks to others, whether or not the depositing Member has requested or received an Exchange. Deposited Weeks may be used by GetAways Advantage Vacation Exchange for purposes that include but are not limited to:

a) to satisfy Exchange Requests.

b) as Bonus Time,

c) as employee accommodations for inspection visits

d) for promotion purposes

e) marketing or other purposes as determined by GetAways Advantage in its sole discretion. Deposited Weeks may not be withdrawn from the GetAways Advantage Vacation Exchange Week Pool once they have been deposited.

Depositing

The maintenance fees on the week being deposited must be paid in full prior to final confirmation of an exchange. The week deposited for the exchange cannot be utilized or assigned to another party or company once it has been deposited with GetAways Advantage Vacation Exchange. The Member must not deposit the week with more than one Exchange Company at a time, in any one entitlement period, as this will cause an overbooking of the unit at the home Resort. Any expenses incurred to an inbound Guest or GetAways Advantage Vacation Exchange, denied access to the deposited week as a result of a double banking with another Exchange Company, will be the GetAways Advantage Member’s responsibility. GetAways Advantage Vacation Exchange reserves the right to reject any deposit at any time before that deposit is cleared and put into the inventory pool. Deposit Credit (Bank & Save Option) When a week is deposited with GetAways Advantage Vacation Exchange the Member will be issued a "Deposit Credit". This Deposit Credit is valid for three (3) years from the date of deposit and is available for the GetAways Advantage Member to exchange against at a future date.

Miscellaneous Fees and Taxes

GetAways Advantage Members are solely responsible for the payment of any and all bed tax, transient occupancy tax, or similar tax that may be imposed in connection with the use and occupancy of the Accommodations pursuant to an Exchange, whether such are included in the Exchange Fee or otherwise imposed. GetAways Advantage Members are solely responsible for payment of any applicable port charges, gratuities, personal expenses, utility charges, security deposits and other fees or charges properly levied by a Resort or other party for the use of amenities and facilities. GetAways Advantage Members are solely responsible for all damage and loss to the Accommodations or Host Resort as a result of GetAways Advantage Member's conduct (and the Guest’s conduct), as well as all personal charges incurred at the Host Resort including, without limitation, telephone calls, Internet service, meals and beverages, and any other applicable and permissible charges imposed by the Host Resort. Some resort stays require, or make available as an option, all-inclusive fees which are due upon, before, or at time of check-in and pay for the Guest's meals and beverages. These all-inclusive programs may include more or less, but are purely at the discretion of the resort. GetAways Advantage Vacation Exchange has identified these resorts and labeled them accordingly in the displayable resort profile online. GetAways  Advantage Members are solely responsible for all-inclusive fee payments to the Resort.

Bonus Weeks

Bonus Time is comprised of deposited weeks that have not been booked in connection with a Confirmed Exchange and are within 6 months of check-in date. Bonus Time can be requested and reserved via email, facsimile, Internet, and telephone. If a Deposited Week is offered as Bonus Time, and the Member desires to book the vacation, the Member has the choice of either (i) depositing a week in exchange for the desired Bonus Week and paying the Exchange Fee, or (ii) reserving the Deposited Week as Bonus Time and paying the Bonus Time Price. Reservations of Bonus Time are not complete until Getaways Advantage Vacation Exchange receives the applicable Bonus Time Price or issues an Exchange Confirmation. Guests may use Bonus Time the GetAways Advantage Member has reserved provided that (i) all Bonus Time reservations must be made by the Getaways Advantage Member on behalf of their Guests and (ii) the GetAways Advantage Member is solely responsible for all damage and loss to the Accommodations or Host Resort as a result of the conduct of Guests and their invitees, as well as all personal charges incurred in connection with Bonus Time including, without limitation, telephone calls, internet service, meals and beverages, and any other applicable and permissible charges.  GetAways Advantage Vacation Exchange may provide two booking options for Bonus Weeks, the Fix-It Booking Option and the Flex-It Booking Option.

Rental Program

​

GetAways Advantage Exchange, in its sole discretion, may but shall not be required to offer Rental Inventory to Members. The type and quantity of Rental Inventory may change from time to time, and Rental Inventory may be discontinued entirely, in Getaways Advantage's sole discretion, without advance notice to Members. Rental Inventory may be subject to additional terms and conditions, including, but not limited to use year limits, blackout dates and cancellation policies. Restrictions and other limitations may apply. Each Rental Inventory transaction may require a combination of fees, cash paid, or Deposit Credit, and may be subject to applicable taxes.

Travel Program

GetAways Advantage Exchange, in its sole discretion, may but shall not be required to offer Hotel Program Inventory to Members. The type and quantity of Hotel Program Inventory may change from time to time, and Hotel Program Inventory may be discontinued entirely, in GetAways Advantage’s sole discretion, without advance notice to GetAways Advantage Members. Hotel Program Inventory may be subject to additional terms and conditions, including, but not limited to use year limits, blackout dates and cancellation policies. Restrictions and other limitations may apply. Each Hotel Program Inventory transaction may require a combination of fees, cash paid, or Deposit Credit, and may be subject to applicable taxes. The terms and conditions of any Hotel Program will be made available, and will be subject to change without advance notice. If any conflict exists between these Terms and Conditions and the Hotel Program terms and conditions, Hotel Provider Program terms and conditions shall take precedence.

 

Cancellations for Exchange and Bonus

 

Fix-It Booking Option. With the Fix-It Booking Option, the transaction is final and non-cancellable by the Member and all amounts paid for such transaction are nonrefundable. Any amounts paid with respect to the transaction will be forfeited to Alderwood Advantage, and Alderwood Advantage shall owe no further duty, liability, or obligation to Member in connection with such forfeited amounts, including but not limited to any Exchange Fee, Monetary Credits, Bonus Weeks Price, Unit Size Upgrade Fees, other fees which may have been charged, and any relevant taxes.

 

Flex-It Booking Option. With the Flex-It Booking Option, fees paid by Member to GetAways Advantage for a cancelled transaction will be fully-returned to the Member’s Getaways Advantage account if GetAways Advantage is properly notified twenty-four (24) hours prior to the check-in date. Upon successful cancellation, any monetary amount related to the transaction will be returned to the Member’s GetAways Advantage account as a Monetary Credit, including any Exchange Fee, Bonus Weeks Price, Unit Size Upgrade Fees, other fees which may have been charged, or any relevant 

taxes. The Monetary Credit will be available for use by the Member for two (2) years. After the expiration of the two (2) years, the Monetary Credit will expire, and GetAways Advantage shall owe no further duty, liability, or obligation to Member in connection with such expired Monetary Credit. If a Deposit Credit was used for the Flex-It transaction, the Deposit Credit will be returned to the Member’s GetAways Advantage account and shall have the original expiration date. If the Deposit Credit is past its original expiration date, the Exchange Credit will be forfeited by Member, and will not be returned to the Member. Members must cancel by telephone at least twenty-four (24) hours prior to check-in in order to take advantage of the Flex-It Booking Option’s cancellation rules (transactions may not be cancelled online unless otherwise provided).

 

Cancellations of Rental Confirmations

 

Cancellation of rental reservations are effective only when notice of cancellation is actually received by GetAways Advantage Exchange Program. If a notice of cancellation is received thirty-five (35) days or less prior to check-in, all fees paid by Member to GetAways Advantage in connection with the rental reservation shall be forfeited by Member in their entirety. In such event, GetAways Advantage Exchange Program shall owe no further duty, liability, or obligation to Member in connection with these rental reservation fees.

 

 

Cancellations of Travel

 

Cancellation of travel reservations are subject to the terms and conditions of the travel provider which may include forfeiture of the entire fee paid in connection therewith.

 

 

Unit Size Upgrade

If the unit size of the deposit is a studio unit or smaller, a unit size upgrade fee will be payable at time of confirmation. If this amount is due, it will be advised at time of confirmation of the Exchange Week.

Guest Names

All bookings must be confirmed with the proper Guest details at the time the confirmation is issued. Multiple bookings confirmed with the same Guest name for similar check-in dates will be considered duplicates and invalid and may be cancelled by GetAways Advantage Vacation Exchange without notice unless prior arrangement has been made with GetAways Advantage Vacation Exchange. If GetAways Advantage Members are allowing Guests to use their time, the GetAways Advantage Member is the responsible party for any damage to unit.

Exchanging Customer Responsibilities When an GetAways Advantage Member exchanges their timeshare week at another Resort, or accepts a Bonus Week or any other promotional offer at a Resort booked through GetAways Advantage Vacation Exchange, the GetAways Advantage Member is responsible (as with their home Resort), to abide by the rules and regulations of the host exchange Resort. If GetAways Advantage Members are allowing Guests to use their time the GetAways Advantage Member is the responsible party for any damage to unit. All transactions are between GetAways Advantage Vacation Exchange and its Members (not the Member’s Guest). The third party rental for profit of confirmed accommodation space provided by GetAways Advantage Vacation Exchange to its Members is not permitted or allowed under any circumstances. All confirmations are noted with the name of the person to check-in at the destination Resort. If for any reason this is to change, the GetAways Advantage Member (not the GetAways Advantage Member’s Guest) must contact GetAways Advantage Vacation Exchange and advise the change to the original confirmation details before check-in. A new confirmation will be issued by GetAways Advantage Vacation Exchange and the destination Resort will be notified accordingly.
